This Release and Waiver of Liability ("Agreement") is entered into by the undersigned ("Participant") in favor of Jungo Land Sailing LLC, its owners, members, managers, officers, employees, agents, volunteers, sponsors, insurers, and affiliates (collectively, the "Released Parties").

1. Acknowledgment of Risks

The Participant understands and acknowledges that operating, riding on, or otherwise using land yachts or other landcraft owned by the Club or its members ("Boats") involves inherent and significant risks, including but not limited to:

• Collisions with other boats, objects, or persons;
• Capsizing, tire blowout, or loss of control;
• Weather and playa hazards;
• Equipment failure;
• Physical injury, illness, property damage, or death.

The Participant voluntarily chooses to participate in these activities, fully aware of the inherent risks.

2. Assumption of Risk

The Participant voluntarily assumes full responsibility for all risks of loss, injury, or damage, whether caused by the negligence of the Released Parties or otherwise, arising out of or related to the use of any Boat.

3. Release and Waiver of Liability

The Participant, for themselves and their heirs, assigns, personal representatives, and next of kin, hereby fully and forever releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, damages, costs, expenses, or causes of action of any kind, including those arising from the ordinary negligence of the Released Parties, that result from or relate to the Participant's use of Boats or participation in any Club-related boating activities in the State of Nevada.

4. Indemnification

The Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to the Participant's use of Boats or participation in boating activities.

5. Condition of Boats

The Participant acknowledges that the Released Parties make no warranties or representations regarding the seaworthiness, safety, or fitness of any Boat, and that it is the Participant's responsibility to inspect the Boat before use.

6. Medical Treatment

The Participant consents to receive emergency medical treatment as may be deemed advisable in the event of injury, accident, or illness during boating activities, and releases the Released Parties from any and all liability for such treatment.

7. Governing Law and Venue

This Agreement shall be governed by and construed under the laws of the State of Nevada, without regard to conflict of law rules. Any dispute shall be brought exclusively in a court of competent jurisdiction located in Humboldt County, Nevada.

8. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Club Stay Policy

Stays at the club are limited to a maximum of 7 days per month. Members should respect the spirit of the club, which is focused on land sailing, and should not use the club facilities as a permanent or semi-permanent home. Members that abuse this policy will be subject to immediate dismissal from the club.

10. Acknowledgment of Understanding

The Participant has read and understands this Agreement, had the opportunity to consult legal counsel, and signs it freely and voluntarily with the intent to be legally bound.
